Rental agreement

Property

The property, Paraíso Tranquilo (“Condo”), is located in Marea34 located on Calle 34 between 10th Avenue and 20th Avenue, Unit 201 in Playa del Carmen, Mexico.

TERMS, CONDITIONS AND POLICIES

Placing a deposit to reserve Condo and signing Rental Agreement certifies that Guest has read and agrees to all terms, conditions and policies set forth in this Agreement.  Reservation will not be held until deposit and signed Rental Agreement has been executed.

Reservations and Payment

To hold reservation an initial payment of 50% of the total amount is due. The remaining 50% is due 60 days before your arrival date. In the event that advance payments for rent are not made when due, the reservation is subject to immediate cancellation in accordance with cancelation term, so that the condo can be rented to another party.  All payments will be made via credit card on booking site or direct on website to Big Rivers Rentals, LLC.

Term of the Lease

The lease begins at 3:00pm on the Check-In Date and ends at 11:00am on the Check-Out Date.  If the unit is available before, then we will be happy to check you in earlier.  Please note that this is subject to availability, and we cannot guarantee any early check-ins.

Minimum Stay

The minimum stay, except for Holiday (Christmas/New Years) Season and Easter Season is two (2) nights.  Holiday Season and Easter Season has a minimum stay of seven (7) nights.  Dates vary year to year based on the calendar. You may stay less nights. However, you still must pay for the minimum nights rental fee.

Age Limit

You must be 25 year or older in order to rent this condo. A valid Photo ID with appropriate date, will be required upon check-in. Should you be unable to check-in due to this policy, no refund will be issued.

Maximum Occupancy

The maximum number of six (6) guests is allowed. There are no exceptions to this policy. More overnight guests than those stated above will result in immediate eviction with no refund.  All guests will register upon check-in at desk.

Nightly Rate and Fees

All rates will be presented in USD and will be paid via credit card on booking site or direct on website.  There will be a nightly rate, a cleaning fee of $55, and a security deposit of $200.  A 5% discount will be applied on any stays of 7 nights or more. 

Security Deposit

Upon check-out and your departure we will have a full inspection of the unit. If there are no damages, the inventory is up to date, no more than reasonable cleaning, and no excessive use of electricity (see below) then we will refund your deposit.  Any repair or replacement cost should there be any damages or missing items or furnishings caused by you or your party during your stay will be deducted from your security deposit. If there is damage to the condo any lost revenues due to the condo not being able to be rented will also be deducted from your deposit. 

If damage exceeds your deposit we will contact you. Should we be forced to pursue legal action to collect for damages above your deposit, the renter shall also be subject to repayment of all applicable legal expenses incurred by owner in its attempts to enforce this provision, including pre- and post-judgment interest.

The security deposit shall be refunded within seven (7) days of the Check-Out Date provided no deductions are made due to (but not limited to):

  • Damage to the property or furnishings, including dishes;
  • No missing items;
  • Dirt or other mess requiring excessive cleaning;
  • Upon departure, condo keys and garage door opener are left;
  • No missing remote controls for television, air units, etc;
  • No linens or towels are lost or damaged;
  • There have been no pets on the premises;
  • There has been no smoking inside the unit or on the condo’s balconies;
  • There is no excessive power usage as outlined below;
  • There have been no violations of the Home Owner’s Association rules;
  • The renter is not evicted by the owner (or representative of the owner), the local law enforcement, the security company employed by the property owner or representative; 
  • There is no other costs incurred by Homeowner due to Guest’s stay;

Electricity is a precious resource and is very expensive in Playa del Carmen. Your rental has included 30 kwh per day.  The remaining usage during your stay has a cost of $0.25 USD per kwh. Any usage beyond that stated above will be taken from your security deposit. Please help us conserve this valuable resource.

Cancellation Policy

A minimum of a sixty (60) day notice prior to the Check-In Date is required for cancellations resulting in a full (100%) refund of rental fees.  Reservations cancelled 31 to 59 days prior to the Check-In Date will result in a fifty percent (50%) refund of rental fees.  Cancellations or changes that result in a shortened stay, that are made within 30 days of the Check-In Date, are not refundable. Early departure does not warrant any refund of rent. We do not offer any refunds for cancelled or rescheduled trips due to hurricane or other travel advisories.  

Furnished Items

Guests will be provided a start-up of paper towels, toilet tissue, dish soap, hand soap, shampoo, shower gel, laundry detergent and one 20 liter bottle of water will be provided. Bedroom and bathroom linens will be provided including towels to use at the rooftop pool. Guests are to bring their own towels to take to the beach as all provided linens are to remain in the Condo. 

Water, Utilities, and Appliances

The water from the tap is not safe to drink in Mexico.  We will provide you with a purified water tank at the time of check-in.  Additional bottles can be purchased at a local OXXO or may be arranged with Management for a fee paid directly to them.

Television and Internet must not be reprogrammed, however you can use your personal Netflix account.  No wire should be disconnected.  If any services need to be reprogrammed by a vendor, the service fee will be deducted from your security deposit.

Appliances will be used for their intended use only.

The bar and grill on the rooftop are available for Guest use.  Guests are required to clean used ares including the grill.

Pets

No pets of any kind are allowed.

Smoking

No smoking or vaping inside the unit or on the Condo’s balconies.  If smoke is detected the Guest will be responsible for any fees necessary for cleaning and ionization.

Parking

Guests will be allowed parking, as available, in the garage.  All vehicles must be registered at the desk.

Housekeeping

The property and all furnishings are to be kept in good order.  There is no daily housekeeping service.  While linens and bath towels and a startup of limited paper products are included in the condo, daily maid service is not included in the rental rate. Guests are to bring their own beach towels. We do not permit towels or linens to be taken from the condo. We do provide a larger towel that can be taken to the pool on the rooftop terrace.

Owner’s Belongings

There is a locked closet reserved for owner’s use only.  This is not to be opened.  Breaking into locked closet will consequently have a charge for any missing items and repairs.  

Pool Rules

  • Pool will be open from 9:00am to 10:00 pm.
  • Parties of more than 6 people are not allowed without prior approval by owner and administration.
  • The users of the pool are required to wear the appropriate clothing, taking care of morality and good manners. 
  • All children under the age of 13 must be supervised. 
  • Glassware is not permitted.  Only use plastic or disposable cups and dishes.
  • Do not have drinks or cigarettes inside the deck of the pool and wood area.
  • Those who use the pool do so under their full responsibility since there is no lifeguard service.

Additional Building Rules

  • No garbage or other objects are to be placed outside the Condo in common areas of the building.
  • All trash must be deposited in the garbage areas that are located in the parking lot of the condominium. The garbage should be separated.
  • No excessive noise including but not limited to music and television after 10:00pm.
  • No hanging any type of clothing, towels, etc on the balconies or corridors.  A drying rack will be provided and can be used within the condo or on the small balcony off the master bedroom.
  • Other rules as expressed on the premises by building administration.

Management Visits

Managers reserve the right to enter the Condo at any time for inspection or repairs.  All attempts to schedule such visit will be made with contact to the Guest.  We will make every effort to avoid disrupting your stay.

Falsified Reservations

Any reservations obtained under false pretense will be subject to forfeiture of advance payment, deposit and/or rental money, and the party will not be permitted to check-in.

Liability and Intent

Neither the owner’s representatives nor the owner of the Condo shall be responsible for any accidents, injuries, or losses to guests before, during, or after occupancy.  This includes accidents in the case of a fire, water damage, wind damage, strikes, political events, acts of war, theft, epidemics, acts of government or other authorities, custom regulations, changes in airline itinerary, etc.  Neither the owner’s representatives nor the owner of the Condo shall be responsible for any stolen or lost items.  The Guest absolves Big Rivers Rentals, LLC, agents and owners of any responsibility derived from any of the instances mentioned above. 

All Guests are subject to Mexican Law.  The Guests named in this agreement is responsible for him/herself and all guests (registered or not).  The Guest acknowledges that Big Rivers Rentals, LLC, agents and owners cannot be held responsible regardless of fault for any accident, loss, damage, or injury suffered by the guest or their party regardless or the nature of said occurrence.

Written Exceptions

Any exceptions to the above mentioned policies must be approved in writing in advance.
